p.000004: inspect any local housing and public or private establishment during daylight hours or during working hours,

p.000004: Article 1.- Reform Articles 134, 143, 155 and 236, of the Health Code, contained in Decree No.

p.000004: Article 134.- The maximum percentage of gross profit in the sale or supply of
p.000004: Pharmaceutical products will be determined by the Ministry of Economy and Commerce, based on the CIF price
p.000004: when it comes to imported products and the ex-factory price on products
p.000004: manufactured nationally.
p.000004: The profit margin on the sale of generic products may be different from that set for the sale of
p.000004: commercial products under the brand.
p.000004: In the sale or supply of pharmaceutical products in hospitals and private polyclinics, to patients receiving
p.000004: medical treatment, the percentage of gross profit will not exceed 25% of the original cost, being
p.000004: mandatory breakdown in the invoice of the drug (s) used with their respective value, for its due
p.000004: verification.
p.000004: Article 143.- The doctor, when prescribing a medication, is obliged to indicate, in addition to the trademark of the
p.000004: product, the generic name of the medication.
p.000004: The establishments authorized for the sale of medicines, through their Regent, must offer the
p.000004: consumer the generic equivalent of the product

p.000004: Article 155.- The Secretariat shall prepare the list of the Basic Table of Medicines of the

p.000004: qualified laboratories and their sanitary registration and marketing authorization in their country of
p.000004: origin; For the purposes of registration in Honduras, preferential and expeditious treatment shall be granted, pursuant to

p.000004: Article 105.- All workers and their organizations are obliged to observe the provisions of the

p.000004: Article 108.- Companies engaged in extractive, agricultural, forestry and transport activities, which
p.000004: by their nature they require work sites outside the main premises, their buildings must be
p.000004: conditioned according to the requirements established in this regard in this Code and its regulations.
p.000004: Article 109.- The Secretariats of Public Health and Labor and Social Welfare and the Honduran Institute of

p.000004: OF DANGEROUS SUBSTANCES
p.000004: Article 127.- In coordination with the Secretariats of Natural Resources, Economy and Commerce,
p.000004: Labor and Social Welfare, Government and Justice, Defense and Public Security, importation will be regulated,
p.000004: manufacture, storage, transport, handling, trade and disposal of hazardous substances such as
p.000004: pesticides, insecticides, herbicides, rodenticides, explosion, corrosive, radioactive, flammable substances and

p.000004: GENERAL DISPOSITION

p.000004: proceed to cancel registrations of all products to which this Code refers and which does not
p.000004: comply with the provisions established by him and his regulations.
p.000004: A record signed by the parties that have intervened shall be taken from all sampling, in which the
p.000004: Sample form and quantity of samples taken. If the owner or responsible of the establishments
p.000004: I will refuse to sign the minutes, a witness will do it for him. The copy will be left to the interested party.
p.000004: SANCTIONS AND PROCEDURES
p.000004: Article 226.- Taking into account the seriousness of the fact and by reasoned administrative act,
p.000004: the violation of the provisions of this Code will be repressed by the corresponding health authority,
p.000004: with any or some of the following sanctions:
p.000004: a) Written warning.
p.000004: b) Single or successive fines, as the case may be, ranging between L.20.00 and L.50,000.00.
p.000004: c) Confiscation of products, substances or artifacts.
p.000004: d) Suspension or cancellation of registration or license; Y;

p.000004: e) Temporary or definitive closure of buildings or establishments. The application of these sanctions will be made
p.000004: according to regulation.
p.000004: Article 227.- The payment of fines does not exempt the offender from the execution of the work, works or measures of character
p.000004: that have been ordered by the authority responsible for control.
p.000004: Article 228.- When the violation of the provisions of this Code results in health risks of the
p.000004: people or for the environment, THE SECRETARY must make public the fact to prevent damage
p.000004: greater.
p.000004: Article 229.- The administrative sanctions imposed by the health authorities, which this Code deals with
p.000004: they do not exempt the offender from civil or criminal liability to the place for the act sanctioned.
p.000004: Article 230.- The application of the sanctions established in this Title will be done according to regulations.
p.000004: In the regulations of this Code, the official or the health authority that
p.000004: in each case they graduate and impose the sanctions listed in this Title.
p.000004: When the regulations do not make the precision referred to in the preceding paragraph, the graduation and taxation
p.000004: sanctions will be made by the hierarchically highest local health authority, according to the LA organic standard
p.000004: SECRETARY.
p.000004: Article 231.- For the purposes of this Code and its regulations, health authorities may take as measures
p.000004: sanitary preventive the following:
p.000004: a) Order the isolation or internment of people to prevent the transmission of diseases.
p.000004: This isolation will be done based on a medical certificate issued by the health authority and would be extended
p.000004: only for the time strictly necessary for the danger of contagion to disappear.
p.000004: b) Order the capture and observation of animals suspected of communicable diseases.
p.000004: c) Order the vaccination of people and animals.
p.000004: ch) Order or carry out disinfection, disinfection or rat control measures, when
p.000004: deem convenient or necessary.
p.000004: d) Order the suspension of work and services when they imply a health hazard for individuals and
p.000004: community.

p.000004: e) Retain or deposit objects that constitute health risks for people or the community.
p.000004: f) Order the unemployment or eviction of establishments or homes, when they threaten the health of
p.000004: persons; Y,
p.000004: g) All conducive to health prevention.
p.000004: TITLE III
p.000004: PROCEDURES IN THE ACTIONS OF HEALTH AUTHORITIES
p.000004: Article 232.- For the purpose of maintaining adequate surveillance of public health, and of
p.000004: compliance with legal and regulatory provisions, health authorities have the power to
p.000004: inspect any local housing and public or private establishment during daylight hours or during working hours,
p.000004: accrediting these powers and following the legal provisions and procedural rules
p.000004: set in the regulations.
p.000004: Article 233.- The health authority, which when conducting an inspection finds a violation of the
p.000004: legal or regulatory provisions will issue an official record of the facts, which must be signed by
p.000004: two witnesses, who may be neighbors or police officers and will put the record in
p.000004: knowledge of the corresponding head in order to initiate the administrative summary, in accordance with the
p.000004: procedure contemplated in the Law of Administrative Procedures.
p.000004: Article 234.- To proceed with the closure of the establishments, in which the provisions are violated
p.000004: legal and regulatory, the health authority will place visible signs indicating the quality of
p.000004: closed by the health authority, and will proceed to seal the machines and locks in order to prevent
p.000004: continue use, activity or entry as appropriate. An act signed by
p.000004: the official and witness, if any, leaving a copy to the interested party, which will be immediately put into
p.000004: knowledge of the superior authority of THE SECRETARY.
p.000004: Article 235.- In all the proceedings that are carried out, care shall be taken to protect public health, but at
p.000004: at the same time, unnecessary inconvenience or damage to the offender should be avoided.

p.000004: FINAL AND TRANSITIONAL PROVISIONS
p.000004: Article 236.- The Executive Power shall issue the Regulations indicated in this Code within a period that expires on
p.000004: August 26, 1992; as long as new regulations are not issued, the current ones will continue in force,
p.000004: as well as the other sanitary provisions in everything that does not oppose this Law5.
p.000004: Article 237.- The files initiated before the validity of this Code will be processed and resolved in
p.000004: compliance with the provisions so far in force.
p.000004: Article 238.- To resolve the aspects of interinstitutional competence that arise in the application
p.000004: of this Code, it is understood that in all matters related to human health aspects, the
p.000004: laws, regulations and other related provisions in this regard that are the responsibility of
p.000004: the Ministry of Public Health; and in relation to animal, plant and other natural resources health, they will be applied
p.000004: laws, regulations and other provisions that are under the responsibility of the Ministry of Natural Resources.
p.000004: In activities where there is interdependence of actions, these will be carried out in coordination between the Secretariats
